Who these terms and conditions apply to
These terms and conditions are designed for consumers.
For professionals (companies, agencies, studios) who wish to establish collaborations with us, we will send our general conditions attached to our quotation.
From time to time we may update these terms and conditions of sale which will become effective from the moment they are published on the site.
We follow the legislation on consumers and electronic commerce.
1 – OBJECT OF THE CONTRACT
These terms and conditions of sale concern all the products offered for sale through our site.
When you buy a product, according to the site procedure, you will receive an email with the link to download the product and a PDF copy of these terms and conditions of sale.
2 – PRECONTRACTUAL INFORMATION FOR THE CONSUMER according to art. 49 Legislative Decree 206/2005 (Italian Consumer Code)
We have structured our store to allow you to view our terms and conditions of sale, the goods offered for sale and their characteristics, as described in the product sheets.
Before proceeding with the purchase confirmation and payment we summarize:
- the total price of the goods, including taxes, with details of any shipping costs and any other costs;
- the payment methods;
- the delivery time of goods (for digital products the download will be immediate, for physical ones it could depend on the time of transport and we will report them there);
- the conditions, terms, and procedures to exercise the right of withdrawal (art 6 of these conditions);
- information that the CUSTOMER will have to bear the cost of returning the goods in case of withdrawal;
- the existence of the legal guarantee of conformity for the goods purchased;
- the conditions of after-sales assistance and commercial guarantees.
The CUSTOMER can at any time and in any case before the conclusion of the contract, have any information relating to Petit Design, the geographical address, e-mail address, information that is reported:

3 – CONCLUSION AND EFFECT OF CONTRACT
The sales contract is concluded when we send you an email with the order confirmation.
The e-mail will contain your data, the order number, the price of the goods purchased, any link to download digital products.
The digital products for which customizations are required, allow the customer to request 2 free revisions to better adapt the product to their own requests.
For physical products will also be indicated any shipping costs and delivery address to which the goods will be sent and the link to print and store the copy of these conditions.
You undertake to verify the accuracy of the personal data contained in the order confirmation email and to promptly notify us of any necessary corrections or changes.
We undertake to describe and present the items sold on the site in the best possible way, it is understood that errors, inaccuracies or small differences between the product shown on the site and the actual product may occur.
For digital products, the Customer acknowledges that the colors and representations may differ significantly with the actual product as a result of the video settings and the resolution of the device from which the website is accessed and therefore are to be considered merely representative.
4 – AVAILABILITY OF PRODUCTS
Product availability refers to the actual availability at the time you placed the order.
However, you must always keep in mind that availability must be considered indicative, because:
- the products could be sold to other CUSTOMERS before order confirmation;
- an information anomaly could occur that would make a product available to the user that in reality is not.
Even after sending the e-mail confirmation of the order sent by Petit Design, there may be cases of partial or total unavailability of the goods. In this case, we will automatically rectify your order by deleting the product and inform you by e-mail about the elimination of the product and the methods of reimbursement of the price paid.
5 – PAYMENT METHODS
We accept payments through Paypal and credit or debit cards.
When sending the order confirmation from Petit Design, Paypal will debit the amount.
All communication and payment takes place through protected lines and encrypted by the banking channels of payment instruments.
6 – PRICES
All the selling prices of the products indicated on the website www.petitdesign.eu are expressed in Euros and do not include VAT pursuant to art. 1, paragraphs 54-89, Law 190/2014 (facilitated flat rate scheme).
Any shipping costs are not included in the purchase price but are indicated and calculated at the end of the purchase process before payment is made.
We have the right to change prices at any time, by invoicing the goods based on the prices indicated on the site at the time of order creation and indicated in the confirmation e-mail that we send you.
In the event of a computerized, manual, technical error, or of any other nature that could lead to a substantial change, not provided by Petit Design, of the sale price to the public, which makes it exorbitant or clearly derisory, the purchase order will be considered invalid and canceled and the amount paid by the CUSTOMER will be refunded within 14 days. from the day of cancellation.
7 – RIGHT OF WITHDRAWAL
The law provides that for digital products or those for which personalization is requested, the CUSTOMER has no right of withdrawal.
For the purchase of material goods, on the other hand, the Consumer Code grants the consumer the right of withdrawal without any penalty and without specifying the reason, within the period of 14 days from the date of receipt of the products.
If you intend to exercise the right of withdrawal, you must notify us by e-mail: email@example.com indicating in the subject “Withdrawal” followed by the order number.
The CUSTOMER may exercise the right of withdrawal also by sending any explicit declaration containing the decision to withdraw from the contract or alternatively to send this model withdrawal form, as per Annex I, part B, Legislative Decree 21/2014.
If you exercise the right of withdrawal, you are required to return the goods within 14 days from the day you notified us of the intention to withdraw from the contract pursuant to art. 57 of Legislative Decree 206/2005.
The goods must be returned to Petit Design, at Alessandra Nisticò, via dei Sabelli n. 82 00185 Rome.
You will have to return the goods intact, in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.) and complete with the attached tax documentation.
We reserve the right to verify compliance with the above, and subsequently, we will refund the amount of the products subject to withdrawal within a maximum period of 14 days.
As required by art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, Petit Design may suspend the reimbursement until receipt of the goods or until the CUSTOMER demonstrates having sent back the goods to Petit Design.
Petit Design will carry out the refund using the same payment method chosen by the CUSTOMER during the purchase phase.
8 – LEGAL GUARANTEE OF CONFORMITY
We try to make use of the best suppliers, but if something goes wrong and you receive a defective product or in any case not in compliance with the orders placed, you will have the right to restore without compliance the product by repairing or replacing the product.
For digital products, it will be sufficient to send an email to firstname.lastname@example.org asking for the product to be revised within 3 working days.
For physical products, you can exercise this right if the defect occurs within two years from delivery of the goods and you must report the defect to Petit Design within two months of discovery.
To exercise this right, you will need to send us an email to email@example.com indicating in the object DEFECTIVE PRODUCT.
In case of defective or non-compliant product, we will arrange, at our expense, to organize the collection of the product.
9 – DELIVERY METHODS
We accept orders from all over the world.
The digital products will be delivered via download link upon confirmation of payment, the material products will be delivered by express courier to the address indicated by the CUSTOMER at the time of the order within the time-frame indicated in the order acceptance email.
For every order placed on the site www.petitdesign.eu, we will issue an invoice for the goods shipped or downloaded. The invoice will be sent via email to the customer after the order has been processed.
The invoice will contain the information you provided during the purchase process.
After the invoice has been issued, it will not be possible to make any changes to the data indicated therein.
10 – RESPONSIBILITY
Petit Design does not assume any responsibility for disruptions caused by:
- force majeure or unforeseeable circumstances, even if dependent on malfunctions and disruptions of the internet,
- in the event that it fails to execute the order within the time stipulated in the contract.
11 – ACCESS TO THE SITE
You have the right to access the site for consultation and for making purchases. No other use, in particular commercial, of the site or its content is permitted. The integrity of the elements of this site, whether sound or visual, and the related technology used remain the property of Petit Design and are protected by intellectual property rights.
12 – COOKIES
The website www.petitdesign.eu uses “cookies”. Cookies are pieces of information relating to the CUSTOMER’s navigation on the site (pages consulted, date and time of consultation, etc.) and which allow Petit Design to offer a personalized service to its customers.
We inform you that you can disable the creation of such files by accessing your Internet configuration menu.
13 – SAFEGUARD CLAUSE
These General Terms and Conditions of Sale consist of all the clauses that compose them. If one or more provisions of these General Terms and Conditions of Sale are considered invalid or declared as such pursuant to the law, regulations or following a decision by a court having jurisdiction, the other provisions will continue to have full force and effect.
14 – APPLICABLE LAW AND JURISDICTION
These General Terms and Conditions of Sale are subject to Italian law.
We will first try to amicably resolve any disputes that may arise, but in the event that we should end up in court, the jurisdiction will be the consumer’s court, if located in Italy.
